Berkeley Heights Resident Makes OPRA Inquiries Accusing Town Councilman Of Non-Compliance

BERKELEY HEIGHTS, NJ - Berkeley Heights resident John "Goop" Mondelli recently filed a Township OPRA request for records regarding Councilman Ed Delia's alleged business on Garfield Street, Berkeley Heights.

The information requested: "Variance for Ram Stained Glass to conduct business on Garfield Street; Fire Inspection for same business; Electric Inspection for same business."

In a letter dated March 27, the township responded to Mondelli's request stating that there were no records on file for a variance for Ram Stained Glass and there is no fire inspection on file.

The zoning officer has visited the property on Garfield Street in response to various complaints made by both Mondelli and Delia against each other for nonconformities associated with each other's properties.

A zoning inspection was made in response to the latest complaint by Mondelli for the zoning violation of the Municipal Land Use Law.  The zoning officer concluded that he did not find a nonconforming business use at the property, nor had he found improper occupancy within the adjoining home as he stated in a letter dated April 4, 2014.

Delia has filed a harassment complaint against Mondelli.  The case will be heard by the Scotch Plains Municipal Court.

Delia told The Alternative Press, "Yes, I had to file harassment against Mr. Mondelli. After three years of harassment and intimidating me, I had to do something.

"It is sad that myself and many township employees have to waste time, money and resources to entertain this obsession. The more I try to ignore his constant antics, the more he continues to harm me," said Delia.

Mondelli responded, "The fact of the matter is, this man is in violation. If complaining that he should be treated equal to the rest of the people in town is harassment, then there's a lot of harassment going on. Why should he be above the law on getting a variance for his business in a residential area?  I filed an OPRA request to see the variance. The results came back with none."
