News 12: Woman Accuses City Cop of Brutality in Holding Cell; Incident Caught on Tape

January 21, 2013 at 2:33 PM

PATERSON, NJ – A woman is preparing a lawsuit against Paterson accusing an off-duty city police officer of slamming her to the ground while she was handcuffed and sitting on a bench in a holding cell at headquarters, according to a report on News 12.

The report by “Kane in Your Corner” includes a videotape of the incident in which Linette Vazquez says she was attacked by Officer Michael Avila in March 2011.

The report says Avila has been disciplined by the Paterson police department, but that a grand jury found no reason to levy criminal charges against Avila. Vazquez and co-workers from the Sunrise Gentleman’s Club were having breakfast the Egg Platter on Crooks Avenue when she had a dispute with Avila and another off-duty who were at the next table, the story said.

Over the past 18 months, Paterson has paid out more than $1.2 million to settle lawsuits alleging abuse by Paterson police officers, according to resolutions approved by the City Council.
