BERNARDS TWP., NJ — A request by the owner of Millington Quarry to split the defunct quarry property off Stonehouse Road into two separate zoning lots — one of about 50 acres, and the other of almost 130 acres — will be carried until Sept. 4 after originally being placed on this Wednesday night's township Zoning Board of Adjustment meeting.
The zoning board meeting is scheduled to begin at 7:30 p.m. on Aug. 7 in the main meeting room at the municipal complex at 1 Collyer Lane in Basking Ridge.
The quarry's application had been filed and came up before the board earlier this year in March _ only to result in an objection by the Township Committee that the quarry would first have to meet the requirements of, and file an update for, its rehabilitation plan for the future of the deeply quarried property.
Ruling on a broader legal motion filed by Millington Quarry, a state judge in May found merit that that an updated quarry rehabilitation plan is needed, but declined to rule on the township's request without a fuller record on the matter.
The group Stop the Quarry had also objected to the subdivision application. Before the meeting in March, the group said that MQI was seeking to subdivide the 'contaminated' and 'non-contaminate' property into two lots, which cut a lake already forming on the property in half.
The Stop the Quarry organization at that time passed along the The NJ Sierra Club's letter to the Bernards Zoning board opposing the subdivision of the property.
“MQI’s proposal would require only the contaminated lot be deed restricted," the letter said, referring to a section of the quarry property where contaminated soil had been identified. The subdivision could allow the second lot to be developed without a deed restriction, the letter said, "allowing the developer to build lakeside homes without having to tell future homeowners of the contamination in the lake," the letter argued.
Following a meeting in March, Michael Lavigne, an attorney representing Millington Quarry, said there would would be "no furtherance of a development plan" by the subdivision of the quarry property. He added the quarry had a potential buyer for the entire property at that time.
