BERKELEY HEIGHTS, NJ - A Berkeley Heights teenager escaped serious injury early Friday evening when he was struck by a drunk driver as he rode his skateboard on Springfield Avenue.

According to police, the 17-year-old was skateboarding on the shoulder of the road at around 6 p.m. when he was struck from behind by Mark Legiec, 39, also of Berkeley Heights.

Police said Legiec was driving a 2004 White Chevrolet Tahoe west on Springfield Avenue when it veered from the westbound lane of travel to the right shoulder and struck the victim, who was skateboarding in the same direction and facing away from the car at the time of impact.

The victim was transported to Overlook Hospital where he was treated and released.

Witness statements and evidence gathered at the scene led officers to believe that Legiec was under the influence of alcoholic. He was transported to the Berkeley Heights Police Department where a breath test revealed he was over the legal limit. He has been charged with driving while intoxicated, reckless driving and assault by auto. He was released into the custody of his attorney.
