BLOOMFIELD, NJ-- After all votes were counted and all voting machines were checked, the Essex County Clerk has certified the election as a tie for the undecided third seat Bloomfield BOE election.  Jill Fischman and Daniel Anderson were the top two vote-getters.

N.J.S.A. 18A:12-15c states that a vacancy in the membership of a school board is to be filled by a special election where two or more candidates receive an equal number of votes at the school board annual election.  However, such special election shall only be held upon recount and recertification by the County Board of Elections of such election result. And only then, will a special election be held within 60 days of the annual school election and only between the tied candidates.

So the Board of Elections is to go ahead and conduct an automatic recount of the school election where the board member candidates are tied.  Notice must be given to the candidates and the school board and two days notice by public advertisement pursuant to the Open Public Meetings Act.
