These are some of the allegations being made by the plaintiffs and their attorney Bryan Mintz, of Mintz & Geftic LLC, against Big City Automotive and its affiliates (Big City) in a Union County class action lawsuit.

This case involves auto-parts delivery drivers who allege that they have been misclassified by Big City as independent contractors, rather than employees.  The drivers argue that Big City misclassified them to try to justify not paying overtime premium pay and that doing so is a violation of New Jersey Wage & Hour laws.  

On Friday, the Court granted Mintz & Geftic’s motion to certify the case a class action, which means that case will now proceed on a class-wide, rather than an individual basis. For a copy of the opinion, click here.
