SOMERSET, NJ — The investigation into allegations of members of the Franklin Township Police Department abusing the practice of granting union leave to members of the Department has been closed, according to a letter dated Sept. 4 from the Somerset County Prosecutor's Office, issued by Somerset County Democrats of New Jersey. 

"An assistant prosecutor conducted a legal review of all documentation provided by the police department's administration,” the letter written by Detective Justin Berger to Acting Chief of Police in Franklin Township, John W. Fodor reads. “The investigation and review of all information currently available to this office indicate that the qualifications for, and the extent and use of 'union time' cannot be discerned in that there is no written documentation concerning that time.”

Berger also says in his letter that the State of New Jersey would not be able to prove the misuse of union time because of how the time was granted by FTPD officials. 

"It appears that the former chiefs and captain either approved or directed others to approve 'union time' in any particular matter and with any particular officer they chose to grant such time," Berger's letter reads. 

Berger's letter went on to say that it doesn't appear that there was "any criminal conduct or administrative policy violations committed by any individual officer who submitted applications for 'union time' that were subsequently approved" and therefore the internal affairs review, "may now be considered closed."

The Somerset County Prosecutor's Office declined to comment. The mayor, township manager, candidates other public officials also did not return requests for comments.
