PORTVILLE, NY – A KIllbuck woman was arrested on Oct. 26 after state troopers found her asleep in her car with the engine running and the headlights on.
Brenda J. Swihart, 49, was charged with DWI and refusal to take a breath test after State Police found her in her car in the 7-Eleven on State parking lot of Route 417 in Portville. Police said she had been operating the car while intoxicated.
According to police, Swihart failed a sobriety test at the scene and refused to take a preliminary breath screening. She was transported to the Olean State Police barracks, where a chemical breath test showed a 0.09% BAC, police said.
Swihart was released and is due to appear in Portville Village Court later this month.
