Mahopac Man Charged With Sexual Assault of a Child

MAHOPAC, N.Y. - A Mahopac man faces felony charges after New York State Police say he sexually assaulted a juvenile on several occasions nearly a decade ago.

On Monday, Sept. 11, state police from the Brewster barracks arrested Fernando Cardenas, 54, and charged him with second-degree course of sexual conduct against a child, a class D felony, and endangering the welfare of a child, a class A misdemeanor.

 Under New York State law, a person is guilty of course of sexual conduct against a child in the second degree when, over a period of time not less than three months in duration, he or she engages in two or more acts of sexual conduct with a child less than 12 years old. Under state law, it is also an element of this offense that the sexual conduct was committed without the consent of the child.

Police said that an investigation conducted by the state Bureau of Criminal Investigation and uniform members revealed that between 2008 and 2009 Cardenas had sexual contact with a juvenile under the age of 12. 

A spokesperson for the Putnam County District Attorney’s office said they could not comment on the case at this point.

According to New York State law, the statute of limitations for felonies of this nature--normally five years for class B felonies and lower— are different when children are involved.

 The Putnam County Court issued the warrant ordering Cardenas’ arrest. He was arraigned in Putnam County Court and sent to the Putnam County Jail in lieu of $100,000 cash bail or $200,000 bond. He is scheduled to reappear in Putnam County Court Oct. 4.

 Investigators ask that anyone with additional information regarding Cardenas contact the State Police by calling 845-677-7300. All calls can remain confidential.
