Essex County Freeholder Board: Passes Resolution Supporting Regulations Governing Ride-share Services

ESSEX COUNTY, NJ – Essex County Freeholder Vice President Brendan Gill announced that a resolution he introduced in support of United Transportation Alliance of New Jersey (UTANJ) and regulations governing all companies providing transportation services to passengers in Essex County was passed this week by the Essex County Board of Chosen Freeholders.
 
“As ride-sharing services continue to grow throughout Essex County, it’s critical they meet the same basic standards as other livery services including adequate insurance coverage and licensing,” said Gill.  “This resolution takes an important step in that direction by establishing a sense of accountability among all transportation services.  We must remain committed to prioritizing the safety of Essex County residents while ensuring workers rights are protected, including our brothers and sisters at UTANJ."
Echoing his comments, Essex County Freeholder Rujus Johnson agreed, "It is vital that we meet the the basic standards to protect our residents."    CWA Local 1039 President Lionel A. Leach is grateful for the support his organization has received from Freeholder Gill and the Essex County Board of Chosen Freeholders, " On behalf of my members, I commend Freeholder Gill for taking the initiative on this critical issue."

RESOLUTION IN SUPPORT OF UNITED TRANSPORTATION ALLIANCE OF NEW JERSEY (UTANJ)
 
WHEREAS, all "transportation services" whether taxicabs, limos or ride-share services must receive the same treatment, not only for drivers but also for the safety of passengers and constituents of the County of Essex; and
 

WHEREAS, as per the relevant New Jersey State Statute, any type of vehicle for hire is required to have the minimum mandated amount of commercial insurance. The personal insurance that the ride share drivers carry and their selective additional insurance that the Transportation Network Companies (TNCs) may provide is not regulated by a state entity and, therefore, puts the safety of passengers at risk by not having enough or any insurance coverage; and
 
WHEREAS, the Board of Chosen Freeholders support the Consumer Alert issued by the New Jersey Department of Insurance and Banking warning drivers about the "risk of driving without proper insurance and/or having inadequate coverage for themselves, their vehicle, their passengers and third parties who may sustain personal injury and/or property damage" when using their vehicle as a Transportation Network Company (TNC) vehicle; and
 
WHEREAS, the Board of Chosen Freeholders support N.J.S.A. 48:16-6, which requires each municipality upon the filing of the required insurance policy to issue a certificate of compliance in duplicate, one to be filed with New Jersey Motor Vehicle Commission (NJMC) and one to be displayed in the vehicle; and
 
WHEREAS, the Board of Chosen Freeholders support N.J.S.A. 48:16-3(b) and N.J.S.A. 48:16-223a(b), which requires all regulated for-hire vehicle drivers to secure a Fingerprint Criminal Background Check by the New Jersey State Police; and
 
WHEREAS, even though the State of New Jersey, under the jurisdiction of the NJMC, is in the process of regulating TNCs within the State of New Jersey, each municipality in the County of Essex must assess the impact that TNCs create within their respective jurisdiction. There are certain risks to the residents and visitors of the County of Essex. Therefore, licensing through the municipalities further ensures that passengers and residents of the County of Essex are safely transported from place to place; now, therefore, be it
 
RESOLVED, that the Essex County Board of Chosen Freeholders hereby support United Transportation Alliance of New Jersey (UTANJ) and regulations governing all companies providing transportation services to passengers in the County of Essex; and, be it further
 
RESOLVED, that a copy of this Resolution be presented to the United Transportation Alliance of New Jersey (UTANJ).
