NEWARK, NJ – A Newark man has been arrested and is charged in connection to a fatal shooting incident, authorities announced. 

Marquise Smith, 26, of Newark, was arrested and charged on Monday with conspiracy to commit robbery, conspiracy to commit murder and felony murder for the fatal shooting of Agustin Pichardo, 51, of Newark, Acting Essex County Prosecutor Theodore Stephens and Newark Public Safety Director Brian O’Hara said. 

Smith is charged with fatally shooting Pichardo during an attempted robbery on April 17 on the 100 block of 7th Street, authorities said.

The victim and another male relative were at a property owned by Pichardo doing maintenance when Smith attempted to rob them at gunpoint, according to authorities. During the robbery attempt, the suspect allegedly shot Pichardo, authorities said. 

Pichardo was takent to University Hospital where he was pronounced dead at 2:13 pm on Saturday.

Smith is currently in custody at the Essex County Correctional Facility.

The ongoing investigation is being handled by the Essex County Prosecutor’s Office Homicide/Major Crimes Task Force, which includes detectives from the Newark Police Department.
