Unable to prove that Adam Bermudez, 29, of East Norriton, was talking on his cell phone when the G&C Waste Services truck he was driving fell into trees and rolled onto its side in a drainage ditch in Hilltown on July 2, 2013, crushing and killing passenger Riccio Rios, 24, of Norristown, the Bucks County District Attorney's Office dropped a homicide by vehicle charge against Bermudez Monday.

Accordng to The Intelligencer, Deputy District Attorney dropped the charge, along with reckless endangerment, and involuntary manslaughter charges, and Bermudez pleaded no contest to  speeding, failure to yield at a yield sign, careless driving and other minor traffic offenses.

The truck overturned as Bermudez turned left onto Dublin Road from Bypass Road, police said. Investigators discovered Bermudez made phone calls after the 4:30 a.m. crash.
