Sealed Bids for providing the following goods (services) to the Township of Nutley will be received at the Clerk’s Office, Town Hall, One Kennedy Drive, Nutley, New Jersey 07110 by Wednesday, October 28, 2020 at 11:00 A.M. prevailing time at which time they will be publicly opened and read, via Zoom. A Zoom invitation link will be sent to all who submitted bids as well as posted on our Nutley Township website: www.nutleynj.org.

Township of Nutley, One Kennedy Drive, Nutley, New Jersey 07110, telephone number 973-284-4960 on Friday, October 9, 2020. Bidders will be furnished with a copy of the
Specifications by the Nutley Purchasing Department for $100.00 non refundable cost plus $10.00 if mailed. Checks shall be made payable to the Township of Nutley. 


Plans and Specifications will be available for review only at the office of the Design Engineer, Neglia Engineering Associates at 34 Park Avenue, Lyndhurst, New Jersey.

Bids must be accompanied by a non-collusion affidavit and a certified check or bid bond for not less than ten (10%) percent of the amount bid, provided said check need not be more than $ 20,000.00, nor shall not be less than $ 500.00, and a consent of surety from a surety company authorized to transact business in the State of New Jersey in a sum equal to one hundred (100%) percent of the amount bid, and be delivered at the place on or before the hour named above.

The Standard Proposal Form and the non-collusion affidavit are attached to the Specifications, copies of which will be furnished on application to the Engineer.

In accordance with P.L. 2004, c. 57, all contracts entered into with the Township of Nutley on or after September 1, 2004, the contractor must be registered with the New Jersey
Department of the Treasury, Division of Revenue and provide a business certificate with the bid.

The contractor shall provide written notice to its subcontractors and supplier of the responsibility to submit proof of business registration to the contractor. The requirement of proof of business registration extends down through all levels (tiers) of the project. Before final payment on the contract is made by the contracting agency, the contractor shall submit an accurate list and proof of business registration of each subcontractor or supplier used in the fulfillment of the contract, or shall attest that no subcontractors were used.

The Contractor will comply with all rules and regulations and orders promulgated by the State Treasurer pursuant to P.L. 1975, c 127, and with all provisions of the N.J.S.A. 11:2 1 through 11:2 4 and all rules and regulations promulgated thereunder, the provisions of which are incorporated herein by reference. Bidders are required to comply with the requirements of N.J.S.A.10:5-31et seq. and N.J.A.C.17:27.

Please be advised that State funds through the Green Acres Program are being utilized in this project. Under N.J.A.C. 7:1-5, vendors currently suspended, debarred, or disqualified are excluded from participation on this project.

The Township of Nutley Board of Commissioners expressly reserves the right to reject any and all bids in accordance with the Law and the Statutes and to waive any informalities in the offers as received.

In the event of tie bids, the Township of Nutley Board of Commissioners reserves the right to award the contract to one of the responsible offers.
