ROSELLE, NJ - On September 9, Superior Court Judge Karen M. Cassidy signed an order agreeing to hear on short notice a case filed by Denise Wilkerson against Reginald Atkins in his capacity as Chair of the Roselle Democratic Committee for allegedly violating the Municipal Vacancy Law and the state statute governing procedures to fill a vacancy. Also named in the lawsuit is Nicholas Scutari in his capacity as County Chair, the Roselle Democratic Committee, Donald Shaw, and the Union County Clerk. The matter is currently scheduled to be heard on September 11.
Wilkerson said, “The law is clear! The many egregious violations of the state statute during this process cannot be ignored. There was a clear and deliberate effort to manipulate the process in their favor. Far too often, people in power, feel as if the rules do not apply to them. It is time for that to end.”
Reached for comment, Mayor Atkins responded, "The lawsuit is another attempt to divide our community and local democrats! The Members of the Roselle Democratic Committee with representation from each Ward spoke loudly with their vote of confidence for Donald Shaw for Mayor. If the ongoing COVID-19 pandemic has taught us anything, it’s that government efficiency and leadership is far more important than any petty difference or personal ego. The people need and deserve a Mayor who they can trust to bring our community together in a crisis and that is why everyone knows and trusts Donald Shaw."
