MONTCLAIR, NJ — For the third time since August, Cuban Pete’s Restaurant and Tapas was issued a citation for violating the Executive Order, officials announced on Tuesday.

According to officials, Montclair Police officers and Montclair Health Department officials had visited Cuban Pete’s Restaurant and Tapas on October 3, after receiving multiple complaints regarding possible indoor dining violations. Health Department personnel then conducted a head count of patrons eating inside and determined that the restaurant was in violation of the Executive Order 183. They indicated that the number of people eating inside exceeded the number allowedn based on the 25% occupancy order. 

During Gov. Phil Murphy’s COVID-19 press briefing on Monday Cuban Pete’s was mentioned for the second time, by New Jersey State Police Superintendent Patrick Callahan, for violations for the number of people in the establishment. According to Montclair Police officials, the owner, Domenic Restaino, was cited for Violation of Executive Order 183.

In August, Restaino was cited for violations on two other instances. In the first cited violation, on Friday, Aug. 7, Police and Montclair Health Department officials were called to the establishment after receiving a tip that indoor dining was taking place. In the second violation took place on August 23, after receiving a noise complaint, Montclair Police went to Cuban Pete's to investigate and noticed that nearly 15 guests were seated at three tables.
