FRANKLIN TOWNSHIP, NJ - David Lutz, age 31 of Somerset was charged with second-degree sexual assault and third-degree endangering the welfare of a child, according to law officials.
"On Thursday, May 25, at approximately 3:25 p.m. Franklin Township Police responded to a 9-1-1 call that was placed from a local business," Somerset County Prosecutor Michael H. Robertson said in a news statement. "The caller reported that an individual, later identified as defendant David Lutz, had been observed touching a minor child (4 years of age) in a sexual nature, specifically by grabbing the child’s buttocks. Store employees detained defendant Lutz until the arrival of law enforcement."
Detectives from the Franklin Township Police Department along with detectives assigned to the Somerset County Prosecutor’s Office Child Abuse and Sex Crimes Unit responded and initiated an investigation, according to the news statement.
According to police, witnesses said Lutz followed the child through the store, and eventually touched the child when the parent was distracted.
Defendant Lutz was lodged at the Somerset County Jail pending a detention hearing.
