SOUTH BRUNSWICK, NJ -- A compliance hearing will take place on Monday, Sept. 23 to address the terms of South Brunswick’s Affordable Housing obligations.

According to a prepared statement from the township that has been posted on its website, the purpose of the hearing is for the Superior Court of New Jersey to determine whether the terms of the township’s 2019 Amended Third Round Housing Element & Fair Share Plan provides a “realistic opportunity for the development of sufficient housing to satisfy the Township’s 1,417 unit Third Round affordable housing obligation in a manner consistent with the court’s decisions.”

The township issued its fair share plan last March and revised it two weeks ago.

The compliance hearing may result in the court granting to South Brunswick an Order of Conditional Compliance and Temporary Immunity. 

The statement says “The Township and the Planning Board of South Brunswick have been engaged in several lawsuits with a number of developers and interested parties since 2015 regarding the Township’s Third Round obligation to provide its fair share of affordable housing. After a trial, the Court determined that the Township had a 1,417 unit affordable housing obligation for the period from 1999 through 2025 and has required the Township to submit a plan that provides for a realistic opportunity for the development of these units, utilizing the properties proposed by the various developers/owners involved in the lawsuits and other properties proposed by the Township. The Township has prepared and submitted to the Court such a plan, under protest, preserving its right to appeal these determinations.”

The hearing will begin at 9 a.m. Sept. 23 before Judge Michael V. Cresitello, Jr. at the Superior Court of New Jersey, Middlesex County Courthouse, Courtroom 303, 56 Paterson St. in New Brunswick.

Any member of the public may appear and be heard at the hearing, at which time they shall have the opportunity to present their position. In advance of the hearing, any public comments or objections must be filed with the court, in writing, no later than Sept. 9, with duplicate copies being forwarded by mail and, if possible, e-mail, to the township, the Special Master, all parties directly involved in the lawsuits as well as other interested parties listed in the court order scheduling the hearing, a copy of which is available on the township’s website and in the township clerk’s office. 

Copies of the plan and all supporting documents are available for public inspection at the office of the Township Clerk, 540 Ridge Road, Monmouth Junction, NJ 08852, during normal business hours, Monday through Friday, 8:30 a.m. to 4:30 p.m.
