UNION, NJ –  Distributors of those business circulars, pamphlets and coupon books typically thrown in Union driveways or on resident's lawns will now require a permit and can only be delivered to recipients who opt-in to receive them.

Additionally, persons walking house to house for business solicitation must first obtain a permit from the Union Police Department by providing information and “a description of such person and sufficient data to show that such person is authentically engaged in the business indicated.”

At their last committee meeting, Union’s Township Committee adopted the ordinance banning persons from canvassing, soliciting for business purposes, distributing business circulars, handbills or pamphlets without first applying for and receiving a license.

“The Mayor and the Township Committee are focused on quality of life issues and the litter left about town associated with these types of unsolicited advertisements often keeps Union from being the beautiful town that it is,” said Assistant Business Administrator Tammie Kopin.

The ordinance was adopted to “assist in creating safe streets free of nuisances within the Township.”  The ordinance says the Township has receive numerous complaints and has seen the proliferation of the distribution of unwanted business circulars, pamphlets, handbills, coupon books. 

“It appears the existing penalty for a violation of the ordinances is not a deterrent and/or seen as a small cost of doing business,” continues the ordinance.  The Township has determined it necessary to adopt an additional penalty scheme to deter the distribution of these material without a permit in order to “compel compliance with the ordinance and to deter the distribution of unwanted such material.”

According to the ordinance, any person, firm or corporation found in violation may be subject to one or more of the following:  a fine, community service or imprisonment in the county jail.  The ordinance goes into effect on Jan. 15.
