West Caldwell Man Charged with DWI and Refusal to Submit to Breath Testing

FAIRFIELD, NJ - The Fairfield Police Department announces the arrest of Daniel Dimaio (21) of West Caldwell, N.J. for driving under the influence, refusal to submit to a breath test and failure to observe a traffic control device, and careless driving on April 7, 2013.

At approximately 12:30 A.M., Officer John McGrory was stopped at the traffic 
light located at Greenbrook Road and Passaic Avenue, he allegedly observed a 1999 Volkswagon, which was traveling northbound, disregard the red traffic signal and proceed through the intersection. He stopped this vehicle on Pier Lane and found it being operated by Dimaio.

During the course of the traffic stop the officer made observations and conducted field sobriety testing which resulted in the officer having probable cause to believe that Dimaio was operating his vehicle while under the influence. As a result he was arrested and his vehicle impounded. While at headquarters it is alleged that Dimaio refused to provide breath samples as is required by New Jersey law. Dimaio was given an initial court appearance date in the Fairfield Municipal Court of April 11, 2013.

It should be 
noted that the charges against him are merely allegations and that he is presumed innocent until proven guilty in a court of law.
