WESTFIELD, NJ — A measure on the Planning Board’s agenda Monday would pave the way for tax incentives to benefit owners who improve their properties in the downtown.
The Planning Board is slated to consider if the town’s special improvement district qualifies as an “area in need of rehabilitation,” a memo from Town Planner Don Sammet states.
While similar to the designation of an “area in need of redevelopment,” Sammet states, the rehabilitation designation under state law grants different powers.
Designating an area in need of rehabilitation does not grant municipalities the power to condemn property, he writes.
Designating an area in need of a rehabilitation allows for five-year tax abatements; while designation of an area in need of redevelopment allows for tax abatements lasting up to 30 years, Sammet writes. The town, he notes, designated properties on Westfield's south side as a “non-condemnation area in redevelopment.”
Earlier this month, the Town Council had referred to the Planning Board the resolution designating the special improvement district a rehabilitation area.
Brindle had said that a rehabilitation designation “would ensure that all downtown stakeholders have an opportunity to participate in and benefit from the revitalization of our downtown.”
